Purchase of Items

When purchasing items, the following applies and is agreed:

You (the purchaser/customer/visitor/client) are wholly responsible for reading the item listing before making a commitment to buy the product.
You enter a legally binding contract to purchase items when you commit to buy and have fulfilled the payment process.
You agree to all terms of use as outlined in this agreement and will not abuse copyright.

Pricing and Services

All prices for services and products offered for sale are listed on the website. Rachel Jane Cox Photography reserves the right to adjust or change prices for products or services displayed at any time.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

All purchases of digital downloads are non-refundable.

All print/physical products purchased are also non-refundable unless otherwise agreed with Rachel Jane Cox Photography.

Use of Images

Images are sold by Rachel Jane Cox Photography as per use outlined in the product description. For clarity these uses are also outlined in these Terms. Customers accept that images are copyright of Rachel Jane Cox Photography and are for personal use only.

Social Media images are low resolution images for (personal use only) social media sharing). These are not suitable for printing. Downloadable files will be sent within 48 hours or purchase.

High Resolution images are to be used for (personal use only) printing, photo albums etc. Downloadable link will be sent within 48 hours of purchase.

Watermarking

All images on the website are watermarked or protected to avoid misuse. You, the customer or visitor accept full liability for any misuse of images.

When sold, images whether digital or printed will continue to have a discreetly placed watermark at the bottom of the image. Any attempts to remove or violate the terms of use of images will be seen as a direct contravention of copyright and subject to consequences set out in the Copyright section of these terms.

All copyright of images remains to Rachel Jane Cox Photography.

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Rachel Jane Cox. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Any violation of these terms may result in permanent or temporary suspension of access to services and products. This will be without notice or any liability to Rachel Jane Cox Photography.

You agree to indemnify and hold Rachel Jane Cox Photography harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
